1. Acceptance and Scope
By accessing or using the Plasma Army website (plasma.army), the MemePad application, or any related services (collectively, the “Platform”), you (“User,” “you,” or “your”) agree to be legally bound by these Terms and Conditions (“Terms”).
If you do not agree to these Terms, you must not access or use the Platform.
These Terms govern your use of the Plasma Army launchpad, documentation, and community interfaces that enable decentralized, permissionless token deployment and related functionality on the Plasma Network.
2. Eligible Users
2.1 User Criteria
The Platform is intended for individuals and entities who are at least 18 years old and have the capacity to form a legally binding contract under applicable law.
By using the Platform, you represent and warrant that you are not prohibited or restricted from accessing decentralized blockchain services under the laws of your jurisdiction.
2.2 Jurisdictional Restrictions
You may not use the Platform if you are a citizen or resident of, or located in, any jurisdiction subject to comprehensive sanctions, embargoes, or prohibitions under applicable law, including (but not limited to): the United States, Canada, United Kingdom, European Union restricted states, Singapore, Hong Kong, Mainland China, Iran, North Korea, Syria, Cuba, Crimea, Donetsk, or Luhansk regions.
Any attempt to circumvent these restrictions (including through VPNs or proxy services) constitutes a breach of these Terms.
3. Nature of Services; No Custody
3.1 Non-Custodial Platform
Plasma Army is a permissionless, non-custodial platform. At no point does Plasma Army or its contributors take possession of, hold, or control user funds, wallets, or private keys.
All actions occur directly on the Plasma Network via self-executing smart contracts. You are solely responsible for managing your wallet credentials, private keys, and access. Plasma Army cannot recover lost access or reverse blockchain transactions.
3.2 Third-Party Protocols and Integrations
The Platform may reference or connect to third-party protocols, decentralized exchanges, or analytics tools. These integrations are not owned or controlled by Plasma Army. We assume no liability for the security, accuracy, or legality of any third-party services.
4. User Responsibilities
4.1 Wallet and Account Security
You are solely responsible for safeguarding your wallet(s), private keys, and devices. Any interaction signed by your wallet is considered authorized by you. Plasma Army cannot assist in recovering lost or compromised assets.
4.2 Compliance with Laws
You are responsible for ensuring that your use of the Platform complies with all applicable laws and regulations, including tax, AML/CFT, and digital asset requirements. Plasma Army does not provide legal, tax, or financial advice and does not guarantee your compliance with any jurisdiction’s laws.
4.3 Proper Use and Conduct
You agree not to:
Use the Platform for any illegal or fraudulent purposes, including scams or money laundering.
Deploy malicious or misleading tokens intended to deceive users.
Interfere with, disrupt, or harm the security or functionality of the Platform.
Upload or execute harmful code, exploits, or spam.
Circumvent access controls or network protections.
Violation of these rules may result in suspension of your use or reporting to relevant authorities.
5. Risk Disclosures
5.1 Token Launch Risks
Deploying and interacting with smart contracts on the Plasma Network involves significant risk. Token values may fluctuate, projects may fail, and malicious actors may attempt fraud. You assume full responsibility for any outcomes related to your token or participation.
5.2 Smart Contract Risks
Smart contracts, while audited by Cyberscope, may still contain undiscovered vulnerabilities or be subject to exploits. Plasma Army cannot be held responsible for losses caused by bugs, network failures, or unexpected behavior of blockchain systems.
5.3 Third-Party Risks
Tokens launched via Plasma Army may trade or integrate with third-party DEXs or protocols. Plasma Army has no control over external markets, liquidity, or pricing and bears no responsibility for any third-party actions or failures.
5.4 Regulatory Risks
Cryptocurrency regulation is evolving rapidly across jurisdictions. New laws, restrictions, or enforcement actions could affect the operation of Plasma Army or the legality of certain activities on the Plasma Network.
6. No Investment Advice or Fiduciary Duty
Nothing on the Platform constitutes investment, legal, or tax advice, nor a recommendation to buy, sell, or hold any token. Plasma Army is a software tool — not a broker, advisor, or fiduciary. You are solely responsible for your actions and decisions.
7. Intellectual Property
7.1 Ownership
All Platform content, including the Plasma Army brand, documentation, interface designs, and software, are the property of Plasma Army or its licensors, unless otherwise stated.
7.2 License and Restrictions
Plasma Army grants you a limited, non-exclusive, revocable license to use the Platform for personal or project-related purposes. You may not:
Copy, modify, or resell the Platform or its components.
Use the Plasma Army name or logo without authorization.
Infringe upon any intellectual property rights of Plasma Army or third parties.
7.3 Open-Source Components
Some Platform components may include open-source software governed by their own licenses. Your use of such components must comply with those respective license terms.
8. Indemnification
You agree to indemnify and hold harmless Plasma Army, its contributors, affiliates, and service providers from any claims, damages, liabilities, or expenses (including attorney fees) arising from:
Your use or misuse of the Platform.
Violation of these Terms.
Breach of applicable laws or third-party rights.
This indemnity obligation survives any termination or suspension of Platform access.
9. Disclaimers and Limitation of Liability
9.1 “As Is” and “As Available”
The Platform is provided strictly “AS IS” and “AS AVAILABLE” without warranties of any kind — express or implied. Plasma Army does not guarantee uninterrupted service, security, or accuracy.
9.2 No Liability for Losses
To the fullest extent permitted by law, Plasma Army shall not be liable for any indirect, incidental, special, or consequential losses (including loss of funds, profits, or data) arising from your use of the Platform.
In all cases, the total liability of Plasma Army and its contributors shall not exceed USD $100 or the equivalent amount you paid for using the Platform in the 12 months preceding any claim.
9.3 Third-Party Disclaimer
Plasma Army is not responsible for the conduct, actions, or outcomes of any external protocol or project launched using its technology.
10. Jurisdiction and Dispute Resolution
10.1 Governing Law
Unless required otherwise by consumer protection laws, these Terms are governed by the laws of the jurisdiction in which Plasma Army’s core development is organized, without regard to conflict-of-law principles.
10.2 Dispute Resolution
Any dispute or claim arising under these Terms shall first be resolved through good-faith negotiation. If not resolved within 30 days, the matter shall be submitted to binding individual arbitration using a recognized international arbitration center suitable for Web3 and blockchain disputes.
Users waive any right to a jury trial or class action.
10.3 Severability
If any provision is deemed invalid or unenforceable, the remaining Terms shall remain in full force and effect.
11. Suspension and Termination
11.1 User Termination
You may discontinue use of the Platform at any time. Plasma Army does not maintain centralized accounts; termination occurs simply by ceasing interaction with the Platform.
11.2 Platform Suspension
Plasma Army reserves the right to suspend or restrict access at its discretion, particularly in cases of abuse, regulatory requirement, or security threat. Provisions concerning intellectual property, risk disclosures, limitation of liability, and dispute resolution will survive termination.
12. Changes to Terms
Plasma Army may modify or update these Terms at any time. Updated versions will be posted on the Platform, and continued use constitutes acceptance of the revised Terms. Users are responsible for reviewing the most recent version regularly.
